RISKS EVERY ARCHITECT/SPECIFIER SHOULD KNOW:

OSHA VIOLATION RISK
- OSHA 1910.23 and CalOSHA §3212 require that ANY HATCH, HINGED and/or has LADDER access, must have either a permanent or removable Safety Rail.
- OSHA is ramping up efforts by hiring 180+ additional building inspectors, placing 1910.23 as the top five expense violation, and top three occurring fine in 2010.
- A non-compliant hatch puts the owner at risk for OSHA fines of $12,000 per occurrence, up to $250,000.
BUILDING DE-VALUATION RISK
-
Owners’ buildings not compliant with OSHA 1910.23 risk purchasers devaluing the property significantly.
-
Replacement or refit of EACH non-complying roof hatch and/or skylight can easily exceed $100,000.
-
Given the extent of de-valuation, the architect/specifier could be held legally responsible.
CRIMIAL AND CIVIL RISK (INJURY/FATALITY)
-
OSHA violations open the building owner and architect to criminal and civil prosecution.
-
The Bureau of Labor Statistics (BLS) report rooftop falls as the number two cause of work-related injuries. As falls from 11+ feet have a mere 50% survival rate, securely protecting the roof hatch is a necessary precaution.
-
The average nationwide litigation settlement for a fatal fall is $4.2 MILLION.
“Architects and engineers face a substantial degree of liability exposure for property damage, economic damages, bodily injury, and wrongful death resulting from their negligence in the design” (STATUTE OF REPOSE, Model Architect and Engineer Liability Laws, Prepared and Endorsed by The National Society of Professional Engineers, The American Council of Engineering Companies, The American Institute of Architects (AIA), and The American Society of Civil Engineers)
