OSHA VIOLATION RISK

  • OSHA 1910.23 and CalOSHA §3212 require that ANY HATCH, HINGED and/or has LADDER access, must have either a permanent or removable Safety Rail.
  • OSHA is ramping up efforts by hiring 180+ additional building inspectors, placing 1910.23 as the top five expense violation, and top three occurring fine in 2010.
  • A non-compliant hatch puts the owner at risk for OSHA fines of $12,000 per occurrence, up to $250,000.

BUILDING DE-VALUATION RISK

  • Owners’ buildings not compliant with OSHA 1910.23 risk purchasers devaluing the property significantly.
  • Replacement or refit of EACH non-complying roof hatch and/or skylight can easily exceed $100,000.
  • Given the extent of de-valuation, the architect/specifier could be held legally responsible
